Ryan Gavin and Dean Hachamovitch, Marketing Guy and Engineer, respectively, for Internet Explorer, have announced that the final build and release of Internet Explorer 9 will indeed be at the party they’re throwing at South by Southwest in Texas on March 14th, 2011. They’ve decided to first announce this to their very favorite community at Channel9, a bunch of developers who are in love with the internet platform, and they’ve spoken here in a video at length what the browser will be able to do.




This browser has been in production for approximately a year, and now they’re going to release it, thanking profusely the community of developers who have stepped up to help them in making this a platform that has a chance at competing with the rest of the powerhouse browsers out in the market today. As you know, Internet Explorer


Hachamovitch will be doing a keynote at MIX 10 as well, showing off how the platform is rolling out, as a sort of “look what we did in a year” sort of thing. These two fellas sitting on the couch are super excited about this rollout and after saying what they came to say, they made sure to prompt Channel9 for what they call an “uncomfortable question.” What Channel9 decided to ask about was HTML5, to which they reply “WE’RE FOR IT!”


Of course the developer community knows this already, so the question is pressed, beyond what HTML5 can do for the everyday user, what does IE9 offer the fringe users who want features that not everyone will use? Hachamovitch replies with a sort of well, we DO do that, we’ve implemented things like Navigation Timing which “got 0% usage on the web,” he then going on to say that they’ve added items that don’t just come from developers who request things, they’ve essentially come up with elements that they and people at Yahoo, Google, and etc have spoken about behind the scenes, bringing these “fringe” features into IE9 at launch.

I read an interesting article this morning that suggested Apple would change its mind and put Adobe’s Flash technology on its iOS devices within a year. I don’t think that’s going to happen.


In an open letter to users, Apple CEO Steve Jobs gave several reasons why he didn’t want Flash on the iPad, iPhone or iPod touch. They are: Flash isn’t open; the full web; reliability, security and performance; battery life; and touch.


Adobe began shipping Flash Player 10.1 for Mobile last June, but even Laptop magazine admitted that “Steve Jobs was right,” and that “Adobe’s offering seems like it’s too little, too late.” Granted, that report was from six months ago, but it still doesn’t bode well for the technology.


There is no doubt that Adobe is making advances with Flash on mobile devices, but I don’t believe future changes will be enough to get Apple to adopt the technology.


Jobs has been very clear that Apple supports HTML5, an open technology that is controlled by a standards committee, not one company. By building support for that technology into Webkit, Apple is ensuring that mobile Web browsers will be able to access what we’ve come to know as the “full web.”


Webkit is used by Google, Palm, Nokia and RIM, so it has a pretty solid base.


One of the arguments often bantered about when the discussion of the “full Web” comes up is video. There is no doubt that Flash made huge strides over the years in having sites like YouTube encode their videos in Flash. But that’s for the desktop.


As Jobs points out, almost all of this video is also available in H.264 format (a format Flash also supports), so it’s viewable on the iPhone, iPad and iPod touch.


“Add to this video from Vimeo, Netflix, Facebook, ABC, CBS, CNN, MSNBC, Fox News, ESPN, NPR, Time, The New York Times, The Wall Street Journal, Sports Illustrated, People, National Geographic, and many, many others. iPhone, iPod and iPad users aren’t missing much video,” wrote Jobs.


You may ask why other companies adopted Flash for their mobile devices when Apple won’t. That’s easy, they are looking for something they have that Apple doesn’t. Considering how hard it is for tablet makers to compete with Apple, any perceived advantage will work.


I’m not an Adobe hater—I know quite a few people that work at Adobe and I think they’ve done some amazing things over the years. Flash for mobile devices isn’t one of them.


Chris Dawson said he gives “Apple a year until they cave [and adopt Flash]. Android tablets will just be too cool and too useful for both entertainment and enterprise applications if they don’t.”


I have been using my iPhone for years and my iPad for one year. I honestly can’t remember the last time I went to a Web site that wouldn’t load because I didn’t have Flash installed. I can load videos from YouTube and a host of other sites too, no problem.


Apple has sold more than 160 million iOS devices and there are no screaming, angry hordes of users breaking down the doors at 1 Infinite Loop demanding Flash on their devices.


In order for Apple to change its mind and adopt Flash, the technology has to be proven to be indispensable and that it will benefit its users. Apple has proven just the opposite is true.

With the company’s future already clouded by Steve Jobs’ latest medical leave, the possibility of the iPad’s chief designer, Jonathan Ive, cashing out ups the uncertainty, Dan Lyons writes.


Is Apple losing its design guru?


When Apple CEO Steve Jobs announced in January that he would take a third medical leave, the biggest concern was the cloud of uncertainty that hovered over the company. Now that uncertainty has become an issue again, as rumors have started swirling that Apple might lose its chief designer, Jonathan Ive.

Reports in Ive’s native England suggest that the man who oversaw the design of the iPhone and iPad wants to spend more time in the U.K., putting him at odds with Apple’s board enough that he would consider leaving the company. Although Ive and Apple won’t comment, the scenario is plausible for two reasons: First, Ive is about to cash in options valued at $30 million that he was granted in 2008; and second, Ive has an especially close relationship with Jobs. 


Whether Ive stays or goes, the brouhaha shows the challenges that Apple is increasingly likely to face given the questions about Jobs’ role in the coming months. One scenario being bandied about by Apple-watchers suggests Ive is making a power play to succeed Jobs; it seems just as likely, however, that he simply may not want to work at Apple if Jobs isn’t there. 


Still others think the entire notion that Ive might leave is completely unfounded. But either way, the whole incident shows how the Jobs health situation is bringing more drama to a company that, until now, has been a model of tight-lipped discipline.


Apple’s products are famous for their sleek designs, and conventional wisdom holds that losing Ive would be a terrible blow to Apple—“Apple’s worst nightmare,” Britain’s Guardian called it. But the truth is, losing Ive may not be as big a deal as some Apple watchers think.


For one thing, Apple has loads of bench strength in every department, and because of its success it can attract just about anyone it wants.


“How much of this is Steve, how much is Jon, how much someone else? Steve always had an eye for design. The designer is only as good as the client,” says Jean-Louis Gassée.


For another, the real genius behind Apple’s designs might not be Ive—but rather Jobs.


That’s the educated guess of Jean-Louis Gassée, a former top executive at Apple and a longtime close watcher of the company who still has many connections there.


Gassée points out that Ive was already working at Apple when Jobs returned to the company in 1996. Ive joined the company in 1992, when Jobs was gone from the company, having been ousted by the board in 1985.


And before Jobs returned to Apple, Ive wasn’t exactly setting the world on fire. The first products that Ive designed under Jobs were the “Bondi Blue” iMac and the somewhat ugly iBook. Ive’s next products, the "desk lamp" Mac and the early metal laptops, were better looking, Gassée says.

HP: What is the one thing you are most proud of that Found Animals has been able to accomplish?



AG: I’m most proud of our accomplishments with the Michelson Prize and Grant program. It’s our own version of the X-Prize and offers $25 million in prize money for creating a low cost non-surgical sterilant for use in cats and dogs. In addition, we are offering up to $50 million in grant funding to help researchers develop a prize winning technology. Sterilization is one of the best tools we have in our arsenal to reduce the number of unwanted pets that crowd the shelter system and overwhelm available resources. Unfortunately, current surgical spay/neuter approaches are expensive and often difficult to access for the pets and people who need them most. A “doggie Depo Provera” or “Kitty Norplant” type of product would revolutionize how we manage the pet population.



We created the program from scratch and its world class. Our Director of Scientific Research, Dr. Shirley Johnston, is world renowned in small animal reproduction and our Scientific Advisory Board is comprised of experts in many fields. Our program staff has created a fantastic grant process and we do outreach to scientists worldwide. So far we’ve received over 140 grant applications and a dozen projects have been approved for funding totaling over $5 million.

But the question remains -- if women can be president, why can't they be citizens? Article 1 of the Universal Declaration of Human Rights declares, "All human beings are born free and equal in dignity and in rights." Yet it took another twenty years after its signing to get the international conventions on political and civil rights and on economic, social and cultural rights -- and, in the United States, another twenty plus years for Congress to adopt legislation ensuring women's political and economic rights. It took another thirteen years for the United Nations to ratify (without the support of the United States) the Convention to End All Forms of Discrimination against Women. And in 2011, the US House of Representatives and other foreign governing bodies still toy with legislation essential to women's identities, ranging from limiting access to reproductive health services and marriage to crafting sentencing guidelines that treat girls and women as felons and charges those that have abducted and abused them with misdemeanors.



In a 1946 column, written before she joined the UN Commission on Human Rights, Eleanor Roosevelt urged women to "call on the Governments of the world to encourage women everywhere to take a more conscious part in national and international affairs, and on women to come forward and share in the work of peace and reconstruction as they did in the war and resistance." More than fifty years later, at the dawn of a new century, the UN Security Council -- pressured by a well-organized international women's lobby, Hillary Clinton, and other stateswomen and embarrassed by the rampant use of rape and genital dismemberment as tools of war -- adopted Resolution 1325. It urged "Member States to ensure increased representation of women at all decision-making levels in national, regional and international institutions and mechanisms for the prevention, management, and resolution of conflict."



Now ten years later, the campaign -- indeed the struggle -- to enforce this resolution rages across the United States as much as it does across Egypt or the Congo or Afghanistan.



It is tempting to construct this resolution narrowly -- to see it as a tool of armistice rather than reconstruction, as a vehicle to protect women rather than empower them. To do so, to paraphrase Albus Dumbledore, would be to do what is easy rather than what is right.



UN1325 is on the front line in the campaign for women's citizenship. It is a battle to ensure that economic, social and cultural rights cannot be divorced from, or considered separately from, political and civil rights. It is the struggle to reclaim democracy promotion away from post-Cold War politics, self-interested development and the campaign against terror and place it at the heart of citizen participation.



Just as important, it is a campaign to ensure women's rights as citizens as much as it is a campaign to force governments to act responsibly to all its citizens. While equality and human dignity have no sex, policy designed without taking stock of gender differences often perpetuates discrimination.



As Eleanor Roosevelt would say, both citizens and governments must "recognize that the goal of full participation in the life and responsibilities of their countries and of the world community is a common objective" and one "which the women of the world should assist one another" in achieving.

With all due respect to Prof. Levitan, his comment is over the top. This opinion is by a presiding judge in a large circuit. He has responsibilities to his judges to help them figure out how to deal with cases where novel, complicated arguments and fact patterns are being presented. I don’t know him, or much about him other than his abreviated CV, but he is in a position where he has incentives to get it right more than to prove that he’s right. There is a difference, and it’s a difference between being on the bench and being an academic (no disrespect, Prof. Levitan). Judges get respect from their peers for being helpful in moving cases along. Professors get attention by being different.


If the judge is wrong, he has the case and the basic rules set up pretty well for an appeal and the issues will be pretty clear. I don’t know if addressed all the claims by Ms. Congress, but I don’t think he needed to. The choice of law and enforceability of the note issues were pretty fatal.


This paragraph of Prof. Levitan’s seems almost entirely incorrect:


“Perhaps the most important thing to note about the opinion is what isn’t there. There was no consideration of the chain-of-title issue in the opinion. Let me repeat, the court said nothing about whether there was proper chain-of-title in the securitization. Instead, the court avoided dealing with it. That means that this ruling isn’t grounds for sounding the “all clear” on chain-of-title. At best, it is grounds for arguing that homeowners won’t be able to raise chain-of-title problems. As we’ve seen with Ibanez, that’s clearly incorrect, and a closer look at the Congress ruling shows that it might be an Alabama special, not applicable elsewhere.”

As for homeowner defenses, I disagree with Prof. Levitan because this case clearly does allow them at an eviction trial, and as I said earlier, allows them a pretty broad path. I see this as a homeowner win, or at least homeowner-favorable.


As for applying Ibanez, the key fact in that case was that there was no prior assignment of the security interest before the foreclosure process began (and the court was extremely liberal about how that could have happened, but still found that it hadn’t – kind of a game over for USBank), and that USBank tried to fix it after the fact, which it couldn’t. This opinion is often egregiously misrepresented as requiring recorded assignments in Mass. – it explicitly does not. It is also cited as involving MERS. It definitely does not, but it may well be a very pro-MERS case in application.


As for the applicability, state district court decisions are hard to cite for authority anyway, and usually a sign that 1) you’re reaching for anything, anything (aka “as some court somewhere held”); or 2) that you’re not familiar with in-state authority. At the district court level, I can only remember one time that I cited out-of-state law (Maryland, and I did so very reluctantly having lived there), and I don’t remember ever having other state cites used against me. I have a strong bias against it unless it’s absolutely necessary. In practice, too much involves statutes that are not perfectly comparable to other states, for one. But, in the case I used, the issue was exactly what I was looking for, a mortgagee’s obligation after receiving a payoff demand for an odd-ball lien securing two notes, and the mortgagee only provided one account, leaving the other note/account unpaid when all was said and done. The court here followed it and held a payoff demand for a single lien requires all relevant account balances to be provided. That was sweet.


More important was that Prof. Bloom agreed that the law regarding notes and mortgages would be Alabama law, and that Alabama has an identical statute to UCC 3-301 for the rights of enforcement by note holders that makes ownership less important than ownership rights. Prof. Levitan calls this a side-step, but it looks like the judge could have cared less who the owner was. Either he’ll be upheld, or he’ll be made to look foolish on appeal. What Adam calls a “side-step” on 1) the applicability of NY law; and 2) whether ownership matters when enforcement rights is really the issue are clearly identifiable questions of law for de novo appeal (that is, the trial court’s opinion on the law doesn’t count for anything).


The take away I have on this case is that Judge Vowell’s circuit allows more defenses to eviction than I am used to seeing. (Minneapolis and St. Paul both have Housing Courts that are cattle calls, and while the judges diligently enforce procedure on noticing the defendant(s), compliance with the Protecting Tenants at Foreclosure Act of 2009, naming all adult parties known who might have putuative independent possessory rights, etc., they do not throw the proceeding open very often to defenses like Ms. Congress’s and are almost always upheld on appeal, admittedly due in part to eviction appeals being exceedingly difficult and expensive if they’re not set up correctly).


What I don’t know is whether he and his judges figure “might as well” if the alternative is that they’re going to see waves of post-eviction quiet titles instead. A few Alabama practitioners perspective would help on this.


Also, it appears there were two trials on this and that makes untangling some of the procedure difficult. The judge says in the middle of page 7 that there was a “first trial.” I’m not sure what happened there or why there was a second trial. Yves?


So, yes. As a district court opinion, it isn’t legal precedent anywhere, just as any other district court anywhere opinion isn’t legal precedent anywhere – appeals courts review questions of law de novo. That’s not what Prof. Levitan said, and I’m pretty sure it’s not what he meant, either.
